They wanted to know more about the “Scrollsâ€? trademark we were applying for, and claimed it conflicted with their existing trademark “The Elder Scrollsâ€?. I agree that the word “Scrollsâ€? is part of that trademark, but as a gamer, I have never ever considered that series of (very good) role playing games to be about scrolls in any way, nor was that ever the focal point of neither their marketing nor the public image.The implication that you could own the right to all individual words within a trademark is also a bit scary. We looked things up and realized they didn’t have much of a case, but we still took it seriously. Nothing about Scrolls is meant to in any way derive from or allude to their games. We suggested a compromise where we’d agree to never put any words in front of “Scrollsâ€?, and instead call sequels and other things something along the lines of “Scrolls - The Banana Expansionâ€?. I’m not sure if they ever got back to us with a reply to this.Today, I got a 15 page letter from some Swedish lawyer firm, saying they demand us to stop using the name Scrolls, that they will sue us (and have already paid the fee to the Swedish court), and that they demand a pile of money up front before the legal process has even started.I assume this is all some more or less automated response to us applying for the trademark. I sincerely hope Bethesda isn’t pulling a Tim Langdell.

I wonder how the legal system there works exactly. In the States, it's easy to file frivolous suits to bankrupt smaller companies. In England however, if you sue somebody and lose, you have to pay for the other parties legal fees. Makes you think twice before filling a lawsuit, that's for sure…
I think it's a great system but I think there's little chance of it ever being like that here unfortunately…i hate that kinda shit. it's gotta suck having your idol stomping in your face with lawsuits lol.
The whole case should be dropped. The only way they should win here is if he is making a game just like it.

When you trademark something that has a title of more than one word, each word in said title becomes trademarked. Also, any time said trademark is infringed upon, you are bound by law to enforce your trademark. If you don't, you lose it.Notch should've done his fucking homework.Notch deserves to be sued after all the hell he's caused in my life.
Fucking creepersEach word is trademarked? So are you saying that of all the trademarks, none share the same words? It's obviously no copyright infringement was intended, and it would never have effected Bethesdas' sales. You know what though? NOW IT WILL effect their sales because IT'S FUCKING STUPID. I guarantee if they go through with this lawsuit, there are going to be a crap load of people who don't buy Skyrim because of it. The Mojang game involves Scrolls so it's a logical title, this is really just all a bit ridiculous. Also, Notch stated several times that he actually loves Bethesda, (I think Bethesda is crap, but whatever), and he never really played it off to be "big studio vs. small studio". That being said he probably shouldn't have gone blabbing on about this until they really knew what was going on, Notch just can't keep his big mouth shut.
